The Honourable Michael A. Penny

The Honourable Michael A. Penny’s arbitration practice builds upon more than four decades of legal experience, including 28 years as a business, corporate, and commercial litigator and 16 years as a judge of the Ontario Superior Court of Justice.

A graduate of the University of Toronto Faculty of Law, Mr. Penny was called to the Bar in 1984 and practised at Torys LLP until his appointment to the Ontario Superior Court of Justice in 2009. As a judge of the Superior Court, he heard matters across the Court’s major areas of jurisdiction, including civil, family, criminal, and Divisional Court proceedings. Most of his judicial career, however, was spent on the Commercial List adjudicating complex corporate, commercial and insolvency-related matters. Mr. Penny served as a team leader of the Commercial List in the final two years of his tenure. He retired from the Court in 2025.

Mr. Penny is a member of the ADR Institute of Ontario.
